Justice Gawai is the second most senior judge of the Supreme Court after the current CJI Khanna. After CJI Khanna retires on 13 May, he will become the 52nd CJI on 14 May.
The tenure of Justice Gawai, who was promoted as a Judge of the Supreme Court on May 24, 2019, will be more than six months as a CJI. He will retire on 23 November 2025. CJI Khanna, who was sworn in as the 51st CJI on 11 November last year, recommended the Union Law Ministry to appoint Justice Gawai as the next CJI. The retirement age of the Supreme Court judges is 65 years. Born on 24 November 1960 in Amravati, Justice Gawai was promoted as additional judges of the Bombay High Court on 14 November 2003. He became a permanent judge of the High Court on 12 November 2005. Justice Gawai has been part of several constitution benches in the Supreme Court, who has given pioneer decisions.
Election bond scheme was canceled for political funding
He was part of a constitution bench of five judges, unanimously retained the decision of the center to cancel the provisions of Article 370, which has given special status to the then state of Jammu and Kashmir in December 2023. Another five -judge constitution bench, which included Justice Gawai, canceled the election bond scheme for political funding. Hearing of security matters of forest, wildlife and trees
In an important decision, a bench headed by Justice Gawai set the All India guidelines and said that no property should be demolished without a show cause notice and the victims should be given 15 days time to respond. They are also leading the bench which is hearing cases related to the safety of forests, wildlife and trees.
He joined the bar on 16 March 1985 and was a permanent lawyer of Nagpur Municipal Corporation, Amravati Municipal Corporation and Amravati University. He was appointed as Assistant Government Prosecutor and Additional Public Prosecutor in the Nagpur bench of Bombay High Court from August 1992 to July 1993. He was appointed as a government lawyer and public prosecutor for Nagpur bench on 17 January 2000.
