Justice Prashant Kumar said that it is common for nursing homes and private hospitals to woo patients for treatment despite not having insufficient doctors or infrastructure.
Prayagraj: I’m not sure what to do. The Allahabad High Court has expressed displeasure over the treatment of patients like “Guinea Pig or ATM Machine”. The High Court dismissed the doctor’s petition against the criminal action initiated against a pregnant woman. Justice Prashant Kumar said that it is common for nursing homes and hospitals to woo patients for treatment despite not having insufficient doctors or infrastructure. The court said that medical facilities have started “behaving like a guinea pig/ATM machine with patients to collect money”. Therefore, the court dismissed the petition of Dr. Ashok Kumar Rai, owner of the nursing home, who admitted a pregnant woman for delivery and surgery.
High court dismisses doctor’s petition
During this time, the anesthetist arrived late at the nursing home for treatment, resulting in the fetal death and the family suffered physical and mental trauma, as well as financial loss. The doctors were challenging the ongoing criminal action against him in this case. The Allahabad High Court dismissed the doctor’s petition and said that medical professionals should be protected, but not those who are running nursing homes without proper facilities, infrastructure or without doctors and looting only patients. After seeing the records, the court found that the case was completely of an accident, where the doctor admitted the patient and did not conduct timely operation due to the non -availability of the anesthetist after taking permission from the family members.
Doctor is responsible for negligence
The court found that it is not a case of the doctor being disqualified, but is it whether he took proper care or negligence in providing treatment on time. The High Court further said that although the consent was taken around 12 o’clock, the operation was done at around 5:30 pm. If the consent was given around 12 o’clock, why was the operation done at around 4/5 am? There is no justification for delay from the doctor/nursing home/hospital. Only doctors/applicants can be responsible for such negligence. This decision of the Allahabad High Court is a strict message for those private hospitals, who are engaged in recovering money from patients instead of timely treatment, the families of the patients are also forced to sell houses and fields for treatment.
