New Delhi: The Supreme Court on Monday dismissed a petition filed against the Punjab Police personnel handing over the investigation of the alleged attack on a colonel over the parking dispute in March. A bench of Justice Sanjay Kumar and Justice Satish Chandra Sharma dismissed the appeal filed by the accused police officers against an order from the Punjab and Haryana High Court. The victim expressed suspicion on police investigation

Advocate Sumir Sodhi appeared on behalf of Colonel Bath in the case. The accused police officials had moved the apex court against the 16 July order of the High Court to transfer the investigation to the CBI. This direction of the court came two days after the High Court reprimanded the Chandigarh police for the investigation of the case. On April 3, the High Court handed over the investigation into the assault case to the Chandigarh Police and directed him to complete the investigation within four months. The petitioner said that the Chandigarh police failed to conduct an independent and fair investigation in the case. A special investigation team led by Chandigarh Superintendent of Police Manjit Sheoran was being investigated. The petition said that the investigation of the case was transferred to the Chandigarh Police on April 3, 2025 and it is being said with great disappointment that despite the FIR being registered for more than three and a half months and three months of handing over to the Chandigarh Police, neither a single accused has been arrested nor any accused has been linked to the investigation.

Colonel and son were attacked in parking dispute

He said that apart from this, the petitioner’s argument about any conscious effort by the investigating agency is confirmed by the fact that no non-bailable warrant, no PO (declared criminal) action or any other legal action from the concerned investigating agency has not been started. Colonel Bath has accused 12 Punjab police personnel of attacking him and his son over a parking dispute and demanded the investigation to an independent agency, preferably to the CBI. In the event of provocation, his identity card and mobile phone were taken away and he was threatened with a fake encounter. Before handing over the investigation to the Chandigarh Police, Bath alleged that a fair investigation under the Punjab Police is not possible.
