The court today canceled the order of the Central Information Commission (CIC) in which it was directed to disclose the information related to the bachelor’s degree of Prime Minister Narendra Modi. Justice Sachin Dutta has ruled on the petition of Delhi University challenging the order of CIC. Earlier, he reserved his decision on 27 February.
High court banned CIC
Significantly, a person named Neeraj had filed an application under Right to Information (RTI). Since then, CIC had allowed inspection of the records of all those students who passed the BA examination in the year 1978 on December 21, 2016. This year, PM also passed this exam. However, since then the order of CIC was banned on 23 January 2017.

Justice postponed the verdict
Let me tell you here that Justice Sachin Dutta had to pronounce the verdict in this matter but the verdict was postponed and said that this decision will now be pronounced on August 25. In the ongoing hearing on this matter, Solicitor General Tushar Mehta, appearing for DU, argued that the order of CIC should be canceled as the right to privacy is above someone’s right to curiosity. But during this time he had said that PM is ready to show his record to the court related to Modi’s degree.
On what basis did DU challenge?
Explain that DU challenged the order of CIC on the basis that it has protected the students’ information and in the absence of public interest, no one has the right to ask for personal information under the RTI law on the basis of ‘only curiosity’. However, before this, RTI had defended the order of CIC on the basis that the RTI Act provided that the RTI Act provides for the Prime Minister’s educational information public in the widespread public interest.
