On the direction of the court, the police will now register an FIR for the suspected death of a young man who took place five years ago. The case is related to the death of 23 -year -old auto rickshaw driver Vivek Kumar, whose body was found on 5 November 2020 in Kondli, a sewer treatment plant of Delhi Jal Board. Vivek’s father filed a petition in the court alleging that the New Ashok Nagar police did not take any action on his complaint, while he had also named the suspect with whom Vivek was last seen. Apart from this, it was clearly visible in the CCTV footage of 1 November 2020 that some people were beating Vivek, yet the police did not register a case. Additional Chief Metropolitan Magistrate Mayank Goyal made serious comments on the full failure of Delhi Police in the order on 18 September.

Police advice to become sensitive

The court said that the victim was entangled in the trap of procedural rules, due to which the accused have escaped so far. The court gave strict instructions to the police to become more sensitive in such cases and said that it is the demand of the hour to show sensitivity against women, children and groups standing on marginalized groups. Now after the court order, the police will have to register an FIR for Vivek’s death. This case raises serious questions on the role of police in justice with law and order and victims. The order further stated that although the final goal is the most desirable, this journey is not always pleasant and sometimes the victims find themselves standing against the system filled with insensitive stakeholders. Many times the victims find themselves in the struggle with the process of laws. The court said that it has always been a case of complete failure for the entire system when accused of heinous crimes like murder manage to visit free.

Next hearing on 25 September

The court found the current case one such example. It was found that the police officers had not registered any FIR to investigate the case. Instead, all the investigating officers (IOs) reported with pre-determined perception that there was no disturbance. The court said that a cognizable offense of murder has been committed and the concerned station house officer (SHO) is directed to register an FIR and file a report under the relevant provisions of the law. The court directed to send a copy of the order to the concerned DCP so that all the concerned Assistant Police Commissioners and SHOs can be made aware of registering an FIR in cases of loss of human life. The court has set the next hearing of the case for 25 September.
