Registrars of Paramedical Council recognize institutions and control the admission process. The High Court order has stalled everything.
New Delhi: The Supreme Court on Friday paved the way for the educational years 2023-24 and 2024-25 to resume the admission process in paramedical courses. On 16 July, a bench of Madhya Pradesh High Court in Jabalpur had banned the ongoing recognition and admission process for paramedical courses for 2023-24 and 2024-25 on a petition filed by the Law Students’ Union. The MP High Court had banned the admission process in paramedical courses after paying attention to the petition filed by the Law Students Union. On behalf of the Registrar of Madhya Pradesh Paramedical Council, senior advocate Mukul Rohatgi said that the High Court has passed such a stringent order on a petition filed by some law students, which have no relation with the case.
Questions raised on the petition of the student of law
The senior advocate cited the Kovid-19 epidemic and said that due to the epidemic some paramedical courses in the states could not start on time. He said that registrars of paramedical councils recognize institutions and control the admission process. The High Court order has stalled everything. How can law students file such a petition? The CJI asked and stayed the order of the High Court. The CJI also issued notices to the state government and others on the petition of the Paramedical Council.
High court found time limit irrational
The High Court found the time limit irrational and questioned how the institutes can start in the academic session 2025 of 2023-24, while they did not exist at the time of the course. He investigated the July 14 order of the Paramedical Council, allowing 166 institutions to conduct courses for 2023-24. However, the High Court said that the syllabus was originally going to run from November 2023 to October 2024 and the last date to apply for the institutions was December 31, 2023. The bench expressed strong objection to the retrospective recognition, saying that it refers to all arguments and sensitivity and questions the understanding of a sensible person that these institutions can be allowed to start the 2023-24 course in 2025.
