New Delhi: The Supreme Court on Monday reprimanded the Samajwadi Party for grabbing the office instead of the office for just Rs 115 in Pilibhit, Uttar Pradesh and spoke of clear misuse of political power. A bench of Justice Suryakant and Justice Joymalya Bagchi told senior advocate Siddharth Dave, appearing on behalf of the political party that it is not a case of fraud allocation, but is a matter of cheating by misusing muscle power and power. The apex court was hearing the party’s plea against the eviction order of the Pilibhit Municipal Council. Dave argued that despite paying rent for the office space, the municipal officials were adamant on evicting his client. He said that a lawsuit was filed demanding a ban on eviction order.
The court described the abuse of power
The bench said that you are a political party. You misused the official position and political power to capture the place. When action is taken, you start missing everything. Have you ever heard about the place of office on rent of Rs 115 in the municipal area? This is a clear case of abuse of power. When Dave demanded eviction for six weeks, the bench said that at this time you are an unauthorized officer. These are not fraud allocation, but occupation of fraud. Dave claimed that the party is being targeted by the officials. The bench said that it would be better to file a writ petition in the High Court and bring any such fraud allocation or possession to the notice of the court. We will welcome this step.
Municipal Council had ordered eviction
Refusing to investigate the petition, the bench did not express any opinion on the petitioner’s trial in the civil court, on which he said that a decision should be taken as soon as possible. The party was challenging the Allahabad High Court’s order of July 2 in which the petition was refused to hear. On June 16, the apex court dismissed a similar plea by the party’s Pilibhit district president against the High Court’s order prohibiting filing a new petition on the issue of eviction order of the local party office. The apex court gave the party freedom to go to the High Court against the municipal decision. The apex court mentioned a delay of 998 days in filing an appeal against the December 1, 2020 order of the High Court on the petition of Anand Singh Yadav. Yadav claimed to be the district president of the party. The party had claimed that the municipal body had ordered to vacate the campus on November 12, 2020 without giving him the opportunity to hear.
