Hearing in Supreme Court on Waqf Amendment Act complete

Waqf Amendment Act: Hearing has been completed in the case of Waqf Law Amendment in the Supreme Court. There was a serious debate in this case from both the side and the opposition.

Waqf Amendment Act: Waqf Amendment Act 2025 (Waqf Amendment Act 2025) The hearing in the Supreme Court has been completed on the petition challenging and the court has also reserved the verdict. The petitioners had said to stop the changes made in the Waqf Act in the apex court. During this, five advocates including senior advocates Kapil Sibal, Abhishek Manu Singhvi and Rajiv Dhawan appeared on behalf of the petitioner and Solicitor General Tushar Mehta, who was representing the center from the other side, was also heard for three consecutive days.

Center supports law in court

During the hearing in the Supreme Court, the government has strongly supported the Waqf Act and the central government said in the beginning of the debate that Waqf is a secular concept from its nature. Therefore, the perception of constitutionality in its favor cannot be stopped at any cost. He further said that the law passed by Parliament is predicted to consider the constitutional consent. At the same time, Kapil Sibal, appearing on behalf of the petitioner, has described the Waqf Amendment Act as non-constitutional. On the other hand, he argued that it has been made a provision to capture through non-judicial process. Also, the government cannot decide which issues can be raised. At the same time, the petitioner demanded in his petition that its three phases should be banned.

Fierce debate on these three issues

  • One of these three issues is that the court should provide non-sufficient soon to the Waqf, Waqf by user or deeds declared by the court.
  • Muslims should be appointed except ex -officio members in the structure and state Waqf boards of the Central Waqf Council.
  • The final issue is when the collector will try to find out whether an property is government or not. So Waqf property should not be considered at all.

What did the Center object?

Solicitor General Tushar Mehta, who appeared in the Supreme Court to favor the central government, said that there is no petitioner which directly affects this law. He also told the court that this law has been prepared after consulting millions of people and now some people can tell the representation of the entire Muslim society. He also said that the Waqf law was going on many mistakes since the year 1923, which has now been repaired.
