If children are stolen from hospital, license will be canceled, SC’s decision

Supreme Court On Child Trafficking: The Supreme Court has given a historic verdict taking a tough stand in cases of child trafficking. The court has directed the state governments to take strict action against the theft of newborns. Justice JB A bench headed by Pardiwala clearly stated that if a newborn child is stolen from a hospital, then the license of that hospital should be canceled immediately.

Bail canceled in Varanasi case

This decision came in a case related to the incidents of child theft in Varanasi and nearby hospitals. In 2024, the Allahabad High Court granted bail to the accused in this case, against which the victims had moved the Supreme Court. In view of the seriousness of the case, the Supreme Court extended its scope and sought a detailed report from the National Human Rights Commission (NHRC) and the Indian Institute of Development.

Now in the latest decision, the Supreme Court canceled the bail of all the accused. The court said that this is a nationwide gang case, whose stolen children have been recovered from West Bengal, Jharkhand and Rajasthan. The court termed the accused as a threat to the society and called the bail order of the High Court negligent. Also, the Uttar Pradesh government was also criticized, as it did not challenge the decision of the High Court.

Strict instructions to state governments

The Supreme Court included the suggestions of the Indian Institute of Development in its decision and ordered all the state governments to implement them. The court said that if she has a newborn theft from a mother who gives birth to a child in a hospital, then the government should first cancel the license of that hospital. This will curb the incidents of child theft.

Parents advise to be vigilant

The Supreme Court advised the parents to be more cautious about the safety of their newborns in hospitals. Also, all the High Courts directed to take details of pending cases related to child trafficking and order the trial court to settle them in six months.

‘Buying a child is not a solution’

The court said in a poignant comment, “If someone’s newborn child dies, the parents are sad, but they assume that the child goes to God. But if the child is stolen, there is no guess of that pain, because the child is now in the hands of an unknown gang.” The court also canceled the bail of those who used to buy children from this gang. The court clearly said that if there is a childless, then it does not mean that they should buy stolen children.
