Actress Aishwarya Rai Bachchan: Delhi High Court has given an important verdict in favor of Bollywood actress Aishwarya Rai Bachchan and protected her personality rights. The Delhi High Court has prevented online platforms and other parties from illegal use of their names, photographs and AI-borne pornographic content. The order was passed on 9 September by Justice Tejas Karia and was made public on Thursday. The court said that using the identity of a famous figure without consent or authority, not only harms their business image, but also violates their right to live their lives. The court also clarified that in such a situation the court cannot close eyes and safety of the victim side is necessary.
Emphasis on security of personality rights
Justice Karia said that in cases of unauthorized exploitation of one’s personality rights, the courts will provide protection to the victims, so that they can be saved from the damage caused. He admitted that Aishwarya Rai Bachchan has presented the prima facie a strong case for prohibition. The court passed the interim order and said that if the case is not banned in this case, it could cause irreparable loss to the right of dignity to the plaintiff and his family. The case is related to the use of Aishwarya Rai’s names, images and AI-borne objectionable material on online mediums. This decision of the court is being considered an important step towards the protection of personality rights.
Many websites were selling names and voice
The lawsuit relates to the misuse of various aspects of his personality, including his name, image, equality, personality, and voice and the defendants are using them for their business benefits without obtaining their consent. The right to publicity, known as personality rights, has the right to protect, control and profit of someone’s image, name or equality. Aishwarya Rai Bachchan’s personality that she has sought to preserve, including her name, voice, image, dialogue payment, and signature. The case has websites like Aishwaryaworld.com, APKPure.com, Bollywoodteeshop.com, KashcollectiveCo.com as a defendant which unofficially sells products with actress names and photographs. Apart from this, the petition also mentions e-commerce platform Etsy, organization ‘Aishwarya Nation Wealth Motivational Speaker, Electronics, Information Technology and Telecommunications Department.
