High Court Justice Shalinder Kaur issued a notice on his revision petition challenging his conviction and punishment and later suspended the sentence.
New Delhi: Giving relief to social activist Medha Patkar, the Delhi High Court on Friday suspended his sentence in the defamation case filed by Delhi Lieutenant Governor VK Saxena. He was arrested in this case and was produced in the session court during the day. Saxena filed the case 23 years ago, when he was leading an NGO in Gujarat. On April 2, a session court upheld Patkar’s conviction in the defamation case, but revised his sentence and released him on “probation of good conduct”.
On April 8, he directed to fill a probation bond of Rs 25 thousand and pre -conditioned the fine of Rs 1 lakh. Probation is a method of non-institutional treatment and conditional suspension of punishment of criminals, in which the culprit is released on a bond of good conduct instead of sending them to jail after conviction. However, a non-bailable warrant (NBW) was issued against him after failing to honor the conditions of probation on the due date.
Judge ordered to release on condition of bonding
On Friday, Patkar was arrested and produced in a session court, after which the judge verbally ordered him to be released on condition of filling the bond. Meanwhile, the High Court Justice Shalinder Kaur issued a notice on his revision petition challenging his conviction and punishment and later suspended the sentence. Underlining the “controversial issues” raised on the suspension of the sentence, the court said that Patkar was detained in the execution of non -bailable warrants. Therefore, under these circumstances, the petitioner is released on bail for giving a private bond in an amount of Rs 25 thousand and a single amount of an amount in an interim manner, so that the trial court can be satisfied. The High Court ordered.
Saxena’s lawyer received two weeks to file a reply on the revision petition
The High Court gave Saxena’s counsel two weeks to file a reply on the revision petition and posted his petition against his sentence in the case on 20 May. Meanwhile, the order on the sentence has been postponed till the next date of hearing. Patkar withdrew his petition challenging his punishment first during the day and filed a new petition. The leader of the 70 -year -old Narmada Bachao Andolan has challenged the order of the Sessions Court, which has upheld his sentence by the magistrate court.
Parikh said that if the petitioner presented the probation bond before the Sessions Court, the revision petition would be sterilized and demanded the suspension of his sentence. Advocate Gajinder Kumar, appearing for Saxena, opposed the petition and objected that this is the misuse of the process of law by the petitioner. He said that Patkar will have to submit probation bonds first and after that the revision petition can be heard on the basis of merit. On April 2, the Additional Sessions Judge rejected the petition challenging the order and said that Patkar was correctly convicted and there was no fact in the appeal against his conviction decision in the defamation case.
