Ladakh violence: The Supreme Court on Monday sought a response from the Center and Union Territory Ladakh on the writ petition filed by Gitanjali J Angamo, wife of activist Sonam Wangchuk. Gitanjali has challenged her custody under the National Security Act and demanded her immediate release. A bench of Justice Arvind Kumar and Justice NV Anjaria, however, refused to give any order on their petition to stating the basis of custody and set the next hearing of the case on 14 October. Wangchuk was detained on 26 September under the Strict National Security Act (NSA). Two days before this, there were violent protests demanding state status and sixth schedule status to Ladakh, in which four people were killed and 90 people were injured in the Union Territory. The government accused him of inciting violence.
Wangchuk is lodged in Jodhpur jail
The NSA gives the center and the states the right to detain individuals to prevent them from working in a “harmful” manner to protect India. The maximum period of custody is 12 months, although it can be canceled before. Wangchuk is lodged in Jodhpur Jail in Rajasthan. Senior advocate Kapil Sibal, appearing on behalf of Wangchuk’s wife, demanded a direction from the apex court to serve on the basis of custody. However, Solicitor General Tushar Mehta presented that the basis of custody has been “served” on the detained person (Wangchuk). Mehta said that there is no legal need to give the wife a basis for custody. Sibal stressed the interim order to provide Aadhaar and said that the custody order cannot be challenged without a copy.
Wife reached Supreme Court for release
Justice Kumar then said, “At this stage, we won’t say anything. However, the bench noticed the statement of the Solicitor General that he would investigate the feasibility of the detention basis. Mehta alleged that the petitioner is trying to campaign with a emotional issue that Wangchuk was denied medical relief and meeting with his wife. The top court instructed the officials to meet the medical requirements. The petition has made a party to the Ministry of Home Affairs, Ladakh Union Territory Administration, Leh’s Deputy Commissioner and Jodhpur Jail Superintendent. Is a violation of
